Our clients instructed an architect to help with making an application to the local council to change a property from offices to residential property.

The architect prepared the drawings and made the application on behalf of the clients and planning approval was achieved.  

The architect then prepared building specification works and drawings to put the work out to tender. The works were carried out in accordance with the architects documents but following this, the local authority issued an enforcement notice stating that the work was not in accordance with planning consent.

The architects documents included the requirement that any new windows and doors were to be made in White uPVC. The original windows and doors were timber and there was no permission for a change of materials.

Our clients, on the advice of the architect, appealed the decision of the local authority but failed. 

As a result of the architects advice and documentation, our clients suffered loss as they were required to change back the windows and doors from uPVC to timber.

Following, our involvement, working under a firm of solicitors, we have successfully arranged settlement of our client’s claim in the sum of £25,000.
