This has been demonstrated by one of our client’s recent successful cases against a well-known national firm of solicitors, whereby we were able to claim back £4,000.00 in compensation, for professional negligence.
Our client first came to us in January 2019 with concerns regarding the handling of her personal injury claim, following a fall in a supermarket, by Slater and Gordon Solutions Legal (“the Defendant”). She was concerned that she was initially told her claim would be worth around between £6,600 and £7,000 but she only received £3,000.00.
In order to get a better understanding and provide the best advice of each case we first reviewed all of the papers available. We took details from the client and requested the client’s file of papers from the Defendant. Following a review of the file of papers we saw that the Supermarket had admitted liability, but the Defendant had failed to comply with doctor’s advice and arrange the physiotherapy, despite confirming to the client that they would arrange such physiotherapy and the client instructing the Defendant to do so. This meant that our client’s injury was not mitigated. The doctor opined, at the client’s first examination following the accident, it would take the client 8 months to recover from neck pain and, 6 months to recover from lower back pain. Our client was examined a second time by a consultant orthopaedic surgeon who opined that our client would have recovered quicker if the Defendant had arranged physiotherapy, as they had promised.
Our client was messed around by the Defendant and was advised to accept an offer of £3,000, despite being told that her claim was worth more than double this amount. All of this meant that there was potential negligence and breach of contract arising from the failure to arrange physiotherapy and the negligent advice on the value of the claim.
We initially sent a letter to the Defendant outlining our client’s concerns and claim, this is known as a letter of claim and it is used on nearly all cases to show the Defendant your case and give them a chance to answer the concerns you have raised. We raised a number of issues in our initial letter which included the concerns mentioned above. The Defendant responded admitting a breach of duty but argued that they advised our client to seek NHS physiotherapy – thus that no additional compensation was payable. We provided advice to the client on the procedure for issuing proceedings and made sure she was aware of any potential risks which come with litigation and any help with fees she may be entitled to. Following this advice our client decided to go ahead and issue proceedings. We assisted our client with the drafting of those proceedings providing advice whenever the client needed it.
Following our advice and assistance our client issued her own proceedings in January 2020 and in March 2020 the Defendant made an offer to settle the claim. We provided advice and assistance with the negotiations of the terms of settlement and was able to negotiate a £4,000.00 settlement for our client.
Within a couple of months of proceedings being issues we were able to settle the claim on advantageous terms for our client. This led to our client receiving her settlement and leaving the following testimonial.
